These rules govern the terms and conditions of the contest called „L’Etape du Tour 2017 Contest (hereinafter the “Contest”); this is the only document that regulates completely and bindingly the rules of this contest.
1. PROMOTER AND ORGANIZER OF THE CONTEST
The promoter of the Contest is Škoda AUTO a.s., with registered office at tř. Václava Klementa 869, 293 01 Mladá Boleslav, Czech Republic, ID No. 00177041, registered in the Commercial Register administered by the Municipal Court in Prague in Section B, Entry 332 (hereinafter referred to as “the Promoter” ).
The organizer of the Contest, which provides practical steps in its organization, is MUSTARD s.r.o., registered office Praha 1 – Nové Město, Masarykovo nábř. 246, 110 00, Czech Republic, ID No. 28531418, registered in the Commercial Register administered by the Municipal Court in Prague in Section C, Entry 148383.
2. TERM AND PLACE OF THE CONTEST
The Contest takes place from May 15, 2017 to May 31, 2017. The Contest takes place on the website www.welovecycling.com/letape-du-tour-2017/ where the communication with contestants primarily takes place too.
3. CONTESTANTS
Any natural person of at least 18 years of age residing in the country, where the Contest takes place, can enter the Contest. This Contest takes place in the following countries: Albania, Andorra, Armenia, Austria, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Canary Island, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Montenegro, Netherlands, Norway, Poland, Portugal, Romania, Russian Federation, Serbia, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, Turkey, Ukraine.
To participate in the contest it is necessary to register at the Contest Web Page via e-mail at any time of the Contest duration, confirm unconditional acceptance of these rules and so give the consent for the Promoter to process personal data, as further specified. The registration (entry form) includes the providing of personal data (full name, e-mail, telephone, city, country) and loading of a picture from cycling app used by contestant.
Technical conditions of the pictures:
Required format of the pictures: JPEG, PNG
Minimum image size: 1,280 × 956 px
Maximum file size: 5 MB
After loading the picture, the resulting profile (the post) cannot be edited by the contestant himself/herself; however, if the contestant asks to delete his/her contest profile, the Promoter will do it as soon as possible.
Each contestant may register only once and only under his/her own name and identity, while the Promoter reserves the right to check this rule by both technical and organizational means.
All persons involved in the preparation of this Contest, namely those persons that are in employment or similar relationship to the Promoter, the Organizer, participating authorized partner Škoda or agencies charged to ensure this Contest and their family members and close persons are excluded from the participation in this Contest.
4. ASSESSMENT OF WINNERS
A Jury appointed by the Promoter, will choose seven winners from the all posts properly and in time loaded; these winners will obtain a possibility to participate in L’Etape du Tour 2017. When the Jury choosing winners, essential is the number of accumulated kilometers of the picture from cycling app used by contestant and is completely independent in its decision-making. While selecting winners the Jury will also take into account an annual mileage of contestants, their activity on social media and fitness. The Jury’s decision on winners is final and no appeal against it is possible.
The winners will be contacted by the Promoter via e-mail or telephone indicated at the registration, and within seven days of the Contest end. They will be invited to state data required for participation in the L’Etape du Tour 2017 and further possible communication. If the winner fails to respond to Promoter’s e-mail sent repeatedly or fails to deliver his/her contact details within three days of its sending off, the prize lapses without compensation.
5. RULES FOR VIDEOS, PICTURES AND OTHER POSTS
The posts (pictures and any other artefacts posted by a contestant), which are illegal, indecent, obscene, or are showing illegal, risky, indecent or any irresponsible behavior according to Promoter’s sole discretion, are excluded from the Contest on principle. The Promoter appeals to the contestant not to break laws, not to risk and to behave responsibly, fairly and politely when making the posts. The Promoter is entitled to check at any time and subsequently reject or exclude the contestant with a post that is unsuitable for the above or any other reason according to its discretion, without any compensation and without any obligation to state the reasons for such decision. The same applies to posts unusable technically for the Contest.
The contestant warrants to be the sole author of the post loaded by him/her and that his/her post and its usage in the following manner do not violate any rights of third parties (shown persons, co-authors or authors of works captured in the video, or used audio-visual works, including music) or other legal conditions. Before posting, the contestant is required to verify that such third parties familiar with rules of this Contest knowingly agreed with its usage in the Contest and they must be ready to demonstrate such consent when required by the Promoter.
The contestant agrees and grants a free license to the Promoter for publishing his/her post including name and author’s portrait or portrait of other persons on the Internet and other communication media in connection with this Contest for a reasonable period, but at least for two years after its end. The posts may be published and distributed as the whole or in part, including static image, also after adjustment, editing or additions. The contestant acknowledges that once the video is posted, it can be distributed on the Internet without Promoter’s intention. The Promoter is not liable for such distribution.
6. L’ETAPE DU TOUR CONTEST
The prize is the right to participate in the so-called L’Etape du Tour 2017 from July 15, 2017 to July 17, 2017 (including the days of arrival and departure). The Le E’tape du Tour 2017 is a physically demanding event, within which is for the winner prepared bike race. Participation is at your own risk. Participation agree that he put on “Škoda AUTO” jersey in the race day and he will ride the race in “Škoda AUTO” jersey. The participants will be provided with transportation from designated airport to the venue and back, as well as accommodation. The transportation to the designated airport should be provided by the participant himself/herself. Through the L’Etape du Tour 2017, the participants will be provided with health insurance. The contestant may be asked to submit a mandatory medical confirmation of his/her eligibility to participate in the L’Etape du Tour 2017. The participants agree with take his/her own bike to the race and gear in good condition. In the case of defect participant own bicycle the organizator do not provide spare bicycle.
7. CONSENT TO PROCESSING OF PERSONAL DATA
With the registration for the Contest, the contestant confirms that he/she knows and accepts the rules of the Contest and, in accordance with the Directive 95/46/EC of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data, expresses the consent to the processing of his/her personal data by the Promoter as an administrator of personal data or by the entities contractually authorized by the administrator to process the personal data in the scope of data stated in order to organize this Contest, to offer products and services of Škoda brand, to survey customer satisfaction and for the needs of market research, as well as in order to distribute commercial communications by electronic means according to the Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, until the eventual withdrawal of consent. Such personal data may be also given to entities that are members of authorized distribution network of the Škoda cars. The consent to the processing of the above data and to use the electronic contact is given voluntarily by the contestant. This consent may be revoked at any time in writing at the Promoter. The data subject is aware of his/her rights arising from those provisions on the protection of personal data, i.e. especially if he/she finds or believes that the processing of his/her personal data is inconsistent with the protection of his/her private life or in conflict with the law, in particular if personal data are inaccurate with regard to the purpose of processing, he/she may ask for clarification or may require the removal of the resulting situation and blocking of personal data, their correction, addition or elimination.
8. RECORD ACQUISITION AND USE
If the contestant becomes a winner, he/she grants the consent for the Promoter to acquire and use his/her portrait, written expressions and picture images and video and audio records relating to his/her person or his/her expressions of personal nature acquired by the Promoter in connection with organization of the Contest and giving or drawing the prize (i.e. participation in the L’Etape du Tour 2017 and during its course) for commercial purposes on all communication media, regardless of their nature, by all of the usual ways, with their subsequent edition or possible connection with other parts and/or inclusion into collection. The contestant grants this consent to the Promoter free of charge, without substantive, time, quantitative, or territorial limitations, and can revoke it in writing at any time. This contest also covers third parties to whom the Promoter provides the record in accordance with its purpose.
9. OTHER IMPORTANT TERMS OF THE CONTEST:
On principle, definite specification of the prize is determined by the Promoter. Prizes showing on the promotion materials are illustrative. Taking the main prize may be physically demanding. To take the main prize, other conditions must be met (passport, visa etc.); winner is obliged to duly consider his/her fitness to participate, particularly health condition. The Promoter is not liable for any damage that might occur as a result of the prize usage by the contestant.
The contestants are not entitled to claim cash or any other performance instead of the prize. The Promoter is not obliged otherwise to the contestants and they are not entitled to any other performance of the Promoter than as expressly set forth in these rules.
The Contestant will be excluded from the Contest if the Promoter finds or has legitimate suspicion of committing fraud or unfair conduct by the Contestant or any other person who helped the Contestant to get the prize, or the conduct that is not fair play or not based on Contestant’s skills according to the Contest Rules.
The Promoter is not liable for the delivery of messages or prizes. The Promoter is not liable for any errors resulting from technical or communication causes. Any complaints or objections will be decided definitely by the Promoter. The Promoter reserves the right to shorten, postpone, suspend or cancel the Contest without compensation or unilaterally amend or supplement its rules for its entire duration, so that the change will be announced at the above web address where the valid and complete rules are also provided.
In no way, this Contest is operated, sponsored or associated with Facebook and Facebook is not liable for it. The information provided in connection with the Action are not provided to Facebook. Any questions, comments or complaints regarding the application must be directed to the Promoter, not Facebook.
This Contest is governed by the law of the Czech Republic, with the exception of the provisions of the laws of the contestants’ countries that exclude it.
