{"id":173318,"date":"2019-04-10T08:45:13","date_gmt":"2019-04-10T08:45:13","guid":{"rendered":"https:\/\/www.welovecycling.com\/wide\/?p=173318"},"modified":"2019-04-12T08:21:37","modified_gmt":"2019-04-12T08:21:37","slug":"should-cyclists-be-licensed-and-insured","status":"publish","type":"post","link":"https:\/\/www.welovecycling.com\/wide\/2019\/04\/10\/should-cyclists-be-licensed-and-insured\/","title":{"rendered":"Should Cyclists Be Licensed \u2013 and Insured?"},"content":{"rendered":"<p><strong>On a bleak English day in March 2019, The Right Honourable The Lord Winston stood in Parliament\u2019s House of Lords and asked whether cyclists \u201criding bicycles in city centres should have a licence and third-party insurance?\u201d<\/strong><\/p>\n<p><!--more--><\/p>\n<p>Let\u2019s take a look at Britain\u2019s legal history of cycling \u2013 and its logic.<\/p>\n<h2><strong>British law and cyclists<\/strong><\/h2>\n<p>As you\u2019d expect, British law deals with cyclists in an anachronistic and quaint fashion. When bicycles first appeared on British highways, Parliament found it convenient to categorise them as other vehicles of the day \u2013 namely horse-drawn carriages. And cyclists are allowed the same privileges as carriages.<\/p>\n<lite-youtube videoid=8e3qQMsmMPQ params=\"enablejsapi=1\" style=\"background-image: url('https:\/\/i.ytimg.com\/vi_webp\/8e3qQMsmMPQ\/maxresdefault.webp');\"><\/lite-youtube>\n<p>This means that bicycles can freely operate on carriageways, dual carriageways, but not motorways. This means that, traditionally, there is a clear legal distinction between bicycles and motor vehicles \u2013 and as such, bicycles haven\u2019t ever been required to meet the standards of motor vehicles.<\/p>\n<h2><strong>UK introduces compulsory insurance<\/strong><\/h2>\n<p>It is safe to say that in the early 20th century vehicle safety standards were not what they are today. A driver\u2019s licence could be obtained without the need of a test, and so the government decided to introduce compulsory insurance to pay for third-party injury.<\/p>\n<lite-youtube videoid=tmBxwbHRD4U params=\"enablejsapi=1\" style=\"background-image: url('https:\/\/i.ytimg.com\/vi_webp\/tmBxwbHRD4U\/maxresdefault.webp');\"><\/lite-youtube>\n<p>When the bill was introduced, carriages were exempt, primarily because the risk of a 15mph horse-drawn vehicle running out of control was significantly lower than a 30mph motor vehicle taking a corner too fast. In Britain, bicycles were generally <a href=\"https:\/\/www.horseandhound.co.uk\/features\/horse-riders-insurance-ride-on-the-road-641134\">treated like horses,<\/a> and to this day neither horse riders nor cyclists are required to have insurance to use public roads.<\/p>\n<h2><strong>Animals and children<\/strong><\/h2>\n<p>There\u2019s an old saying in the TV industry \u2013 never work with animals or children. The same could be said for the road. In the UK there is currently no lower age limit for a child to cycle legally on the road. In theory, you could be driving your car and see a 3-year-old sharing your lane on a balance bike. Legally. That\u2019s why UK schools offer a Cycling Proficiency programme.<\/p>\n<lite-youtube videoid=c1_16Mr1lOI params=\"enablejsapi=1\" style=\"background-image: url('https:\/\/i.ytimg.com\/vi_webp\/c1_16Mr1lOI\/maxresdefault.webp');\"><\/lite-youtube>\n<p>This does put a huge onus on motor vehicle drivers to be alert and aware of who we share the roads with \u2013 but presumably that\u2019s business as usual for any of us driving a \u00a320,000 vehicle.
